1. Acceptance of Terms

By accessing and using Hemistich ("the Service"), you accept and agree to be bound by these Terms of Service. Hemistich is operated by Creativity Verse Ltd ("we," "us," or "our"). If you do not agree to these terms, please do not use the Service.

2. Description of Service

Hemistich is an AI study companion for students. It is available on the web, as an installable web app, and through a WhatsApp bot. It provides academic tools including but not limited to:

• Summaries, explanations, study notes and step-by-step problem solving
• Quizzes, mock exams and flashcards
• Slides, infographics and sourced research overviews
• GPA/CGPA calculation, study planning, a weekly timetable and reminders
• Scholarship and opportunity search
• A personal vault for storing study material
• Voice features: a spoken conversation with a tutor (Talk), dictation (Speak), and having results read aloud (Listen)

Some tools are available only on certain plans, and some use credits. Features can change over time. Where you use the WhatsApp bot, that part of the Service is also subject to WhatsApp's own terms of service.

3. Eligibility and Your Account

To use Hemistich, you must:

• Be at least 16 years of age
• Create an account with a valid email address (or sign in with Google), or link a WhatsApp number
• Give accurate information when you sign up and keep it up to date
• Comply with all applicable laws in your jurisdiction

You are responsible for keeping your password and your device secure and for everything done through your account. Please do not share your account. Tell us promptly if you think someone else has accessed it.

4. Acceptable Use

You agree NOT to use Hemistich to:

• Submit academic work generated by the bot as entirely your own (academic dishonesty)
• Upload illegal, harmful, or copyrighted content without authorization
• Spam or abuse the service with excessive requests
• Attempt to reverse-engineer, hack, or disrupt the service
• Use the service for any commercial purpose without permission
• Harass, threaten, or harm other users or the service operators
• Upload content containing malware or malicious code

5. AI-Generated Content

Please be aware that:

• Hemistich uses AI (Google Gemini) to generate responses, summaries, quizzes, flashcards and other results.
• AI-generated content may contain errors or inaccuracies.
• Speech recognition can mishear you, especially with background noise or strong accents. Check the transcript before relying on it.
• The voice you hear in Talk and Listen is a computer-generated voice, not a recording of a real person.
• You are responsible for verifying the accuracy of any information provided.
• AI responses should be used as study aids, not as definitive academic sources.
• We do not guarantee the correctness of GPA calculations - always verify with your institution.

6. Rate Limits and Fair Use

To ensure fair access for all users:

• Usage limits apply to AI-powered features, including your plan's credits and monthly voice allowance
• File upload sizes are limited
• Excessive or abusive usage may result in temporary or permanent restrictions
• We reserve the right to modify rate limits at any time

7. Intellectual Property

• You retain ownership of all content you upload to Hemistich.
• By uploading content or speaking to the Service, you grant us a limited license to process it, including by sending it to the AI and speech providers described in our Privacy Policy, for the purpose of providing the service.
• The Hemistich name, branding, and code are our intellectual property.
• AI-generated outputs (summaries, quizzes, etc.) may be used freely by you for personal academic purposes.

8. Service Availability

• We strive to maintain 24/7 availability but do not guarantee uninterrupted service.
• The service may be temporarily unavailable due to maintenance, updates, or technical issues.
• We are not liable for any loss resulting from service downtime.
• We reserve the right to modify, suspend, or discontinue the service at any time.

9. Limitation of Liability

To the maximum extent permitted by law:

• Hemistich is provided "as is" without warranties of any kind.
• We are not liable for any academic outcomes resulting from use of the service.
• We are not responsible for data loss, though we take reasonable measures to prevent it.
• Our total liability shall not exceed the amount you have paid for the service (which is zero for free users).

10. Account Termination

We may suspend or terminate your access to Hemistich if:

• You violate these Terms of Service
• You engage in abusive or harmful behavior
• Your usage patterns suggest automated or bot-driven access
• Required by law or regulation

You may stop using the service at any time. To delete your data, see our Data Deletion page.

11. Changes to Terms

We reserve the right to modify these terms at any time. Material changes will be communicated in the app or by email, and we will update the "Last updated" date above. Continued use after changes constitutes acceptance of the new terms.

12. Governing Law

These terms are governed by the laws of the Federal Republic of Nigeria, including the Nigeria Data Protection Act (NDPA) 2023, without regard to conflict-of-law rules. Where you use the service from outside Nigeria, mandatory consumer-protection laws of your country of residence may also apply. Any disputes shall be resolved through good-faith negotiation first.

13. Payments & Related Policies

Paid plans and credit purchases are governed by our Payments & Refund Policy. Your use of the service is also subject to our Privacy Policy, Acceptable Use Policy, Intellectual Property terms, and AI Disclaimer. Together these make up the full agreement between you and Hemistich.
